The data controller is Guided Experiences LLC, with Registered Office at 76 Greene St, 4th Fl New York, NY, 10012, United States, and Registered Address at 2140 S Dupont Hwy, Camden, DE 19934, United States ("Guided Experiences", “we”, “us” or “our” in this Privacy Policy). Guided Experiences LLC is a fully owned Fever company.

Personal data we collect and purposes of collection

We collect only personal data that is necessary for the core functionality of the App, such as your User ID (linked to your Fever account), Usage data (data about your activity in the App), Crash data (iOS operating system, version, device type) and Location data.

The only purposes for which we collect and process this data is for analytics purposes and App functionality.

Your Location data will only be visible to Guided Experiences when you open the App, but it will not be stored. Your Location data will not be accessible to us when the App is not active.

Legal basis for processing

We process your personal data in accordance with the applicable laws and this Privacy Notice. Most frequently, we will use your personal data (i) where we need to perform the contract we are about to enter into or have entered into with you (to provide the services), (ii) where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests, (iii) where we need to comply with a legal or regulatory obligation.

Recipients of Personal Data

We may share your personal data within the Fever companies (with our parent companies, subsidiaries and/or affiliates) for purposes consistent with this Privacy Notice. Our parent companies, subsidiaries and affiliates will be bound to maintain that personal data in accordance with this Notice. Since you bought tickets for a Fever Experience, we may contact you using your Fever Account details when necessary for managing the services we are providing to you. We may also share your personal data with service providers such as data storage providers (Google Firebase) and analytics and diagnostics providers (Unity).

We will not sell or share your personal data to any third party according to (i) the California Consumer Privacy Act (“CCPA”), (ii) the California Privacy Rights Act of 2020 (“CPRA”) and (iii) any other applicable laws of the United States of America.

International Transfers

As a general rule, if you are a user resident in the EU, please note that we will store your personal data in the EU. However, in some limited circumstances, we may transfer your personal data to Fever subsidiaries or to third party service providers located in countries outside of the European Economic Area (EEA) that do not provide the same level of data protection as the EEA. In such cases, we will ensure that adequate safeguards are in place to protect your personal data.

Data Retention

We will retain your personal data as long as you are registered to use the services.

If you decide to stop using our services, we will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymize your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

We will ensure the secure deletion of your personal data as soon as the processing is no longer sustained by one of the legal grounds mentioned above.
